Terms of Service & Disclaimer

These terms apply to every remote e-tune, street tune, dyno tune, datalog review, video-call session, and any other calibration service provided by JDM Ultra ("we", "us"). By submitting the intake form, making payment, or flashing any file we provide, you ("you", "the customer") agree to everything below.

1. Off-road and closed-course use only

• All calibrations, map files, and modifications we provide are sold and intended solely for off-road, closed-course, and competition use.
• Modifying engine management may violate federal, state, or local emissions laws, including the U.S. Clean Air Act and California Air Resources Board (CARB) regulations. Many of our services alter or disable emissions-related functions. It is your responsibility to know and comply with the laws where you live and drive.
• We do not represent that any tuned vehicle is legal for street use, will pass an emissions inspection, or complies with any regulation.

2. Assumption of risk and engine damage

• Increasing engine output raises stress on every component: pistons, rods, ringlands, head gaskets, bearings, turbochargers, transmissions, clutches, differentials, axles, and more. Modified engines can fail without warning, even on a conservative calibration.
• We calibrate based on the datalogs and information you provide. We cannot see, hear, or inspect your car remotely. Boost leaks, weak fuel delivery, bad fuel, worn or incorrectly gapped spark plugs, failing sensors, low oil, clogged injectors, mechanical wear, and pre-existing damage can all cause a failure that no calibration can prevent.
• You accept all risk of engine, drivetrain, electrical, or other vehicle damage, loss of use, diminished value, and any related costs arising from tuning, flashing, logging, dyno operation, or driving a tuned vehicle.
• Vehicle manufacturers may void or deny warranty coverage on tuned vehicles. That is between you and the manufacturer.

3. Your responsibilities

• Provide a complete and accurate list of every modification, the fuel in the tank, and any known problems. A calibration built on wrong information is dangerous. If you change anything after we start, tell us before you drive on the map.
• Make sure the car is mechanically sound before tuning: healthy plugs at the correct gap, no boost or vacuum leaks, a fuel pump and injectors sized for the fuel, fresh fuel of the grade being tuned for, correct oil level, and no stored trouble codes.
• Follow our logging instructions exactly. Do not perform wide-open-throttle pulls until we have reviewed your idle, cruise, and part-throttle logs and told you it is safe to do so.
• Verify E85 and flex-fuel ethanol content. Fuel quality and ethanol percentage vary by station and season and are outside our control.
• Use only the files we send you, on the vehicle and hardware they were built for. Do not flash a map built for one car onto another.
• Stop driving and contact us immediately if you notice knock, hesitation, misfire, smoke, unusual noises, a check-engine light, or any other abnormal behavior.

4. Driving, logging, and safety

• You are solely responsible for how, where, and when you drive. Datalogging that involves wide-open-throttle acceleration or high speed must be done on a closed course, private property, or a dyno. Where that is not possible, you alone are responsible for obeying all traffic laws, speed limits, and safe-driving practices.
• Never operate a laptop, tablet, or Accessport while the vehicle is moving. Use a passenger to handle logging, or set up automatic logging before you drive.
• We are not responsible for traffic citations, accidents, injuries, property damage, or any other consequence of driving, racing, or logging a vehicle.
• For street tunes we ride along or drive the vehicle. You represent that the vehicle is insured, registered, mechanically safe, and that you have authority to allow us to drive it. You remain responsible for the vehicle at all times.

5. Dyno sessions

• Dyno tuning is performed on rented dyno equipment at a third-party facility. That facility's rules, waivers, and liability terms also apply, and you may be asked to sign them.
• Dyno operation places sustained high load on the engine and drivetrain. Failures during a dyno session are covered by the assumption of risk in Section 2. We are not responsible for damage to the vehicle, tires, or drivetrain during dyno operation.
• Dyno power figures are for calibration purposes. Numbers vary between dynos, weather, fuel, and correction factors, and we make no guarantee of any specific horsepower or torque figure.

6. No guarantees

• We do not guarantee any specific power output, fuel economy, drivability outcome, race result, emissions result, or reliability.
• Turnaround times on the site are typical, not promised. Delays caused by your logging schedule, hardware problems, or file issues on your end are not grounds for a refund.
• All services are provided "as is" without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

7. Payment, revisions, and refunds

• Remote e-tunes are paid in full before the first base map is sent. In-person services are paid at the time of service unless agreed otherwise in writing.
• Each e-tune includes the number of datalog revisions listed on the pricing page. Additional revisions are billed at the posted add-on rate.
• No refunds are issued once a base map has been delivered. Calibration work is custom labor and cannot be returned.
• If a hardware problem surfaces mid-tune, we will pause. Your unused revisions remain available for six months from the original purchase while you fix the problem.
• Video-call diagnostics are billed in 30-minute minimum increments and are non-refundable once the call has started.

8. Files, licensing, and third-party tools

• Calibration files we create remain our intellectual property. You receive a non-transferable license to use them on the single vehicle they were built for. You may not resell, share, redistribute, or reverse-engineer our files, or use them as a base for tuning other vehicles.
• COBB Accessport, Accesstuner, EcuFlash, RomRaider, Tactrix OpenPort, DimeMod, and any other software or hardware are products of their respective owners and are subject to their own licenses. We are not responsible for their function, availability, or compatibility with your vehicle or firmware.
• Any licenses required by third-party software (for example, a DimeMod patch for open-source flex fuel) are purchased by you directly from the vendor and are not included in our pricing.
• We are not affiliated with, endorsed by, or sponsored by COBB Tuning, Subaru, Mitsubishi, General Motors, or any other manufacturer named on this site.

9. Limitation of liability

• To the fullest extent permitted by law, JDM Ultra and its owner shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including engine or drivetrain damage, loss of use, towing, repair costs, diminished value, lost income, or personal injury, arising from or related to our services.
• Our total liability for any claim shall not exceed the amount you paid us for the specific service giving rise to the claim.
• Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the smallest amount the law allows.

10. Indemnification

You agree to defend, indemnify, and hold harmless JDM Ultra and its owner from any claim, demand, loss, or expense (including attorney's fees) arising from your use of our services, your vehicle, your driving, your violation of any law, or your breach of these terms, including claims made by passengers, other drivers, or third parties.

11. Eligibility

You must be at least 18 years old and the owner of the vehicle, or have the owner's written permission, to purchase our services.

12. Changes to these terms

We may update these terms at any time. The version posted on this page at the time you submit an intake form or make payment is the version that applies to that service.

13. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute shall be resolved in the state or federal courts located in Santa Clara County, California, and you consent to that jurisdiction.
